1. Introduction

1.1 Website usage agreement between Sound Start Ltd. and the user.

1.2 Use of this site constitutes agreement with the following terms and conditions. These terms and conditions are governed by and interpreted in line with English law. We advise that you read these terms and conditions carefully and that in the event you are not able to accept them in full, you do not continue to access our website.

If you are a person aged sixteen or under, you must seek the permission of a parent or guardian and ensure that they read and agree fully with the terms and conditions on your behalf before accessing or using our Website.

If you are a parent or guardian and you provide your consent to your child’s use of this web site, you agree to be bound by these terms and conditions together with our privacy policy in respect to their use of this web site.

2. Use of Content

2.1 Throughout our website, trademarked names are regularly used. However, rather than repeatedly show the trademark symbol, we use such names in an editorial contact with no intention of infringement of that trademark. Trademarked names, as always, remain the property of their respective companies.

2.2 We, or our Affiliates, own the copyright and all other intellectual property rights associated with the content on this site save where otherwise stated.  This content includes, but is not limited to, the design, layout, look, appearance, graphics and downloadable media. Any form of Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

Where our website requires you to provide information such as when using the contact form, contacting us via email or when using certain interactive features offered by our website, you must ensure that this information is accurate.  We accept no responsibility in the event that inaccurate/out of date information is supplied to us.

Though we have no initial control over any material submitted in our interactive area(s), We reserve the right to edit and/or remove any material for any reason we deem to be valid, such a decision shall rest solely and exclusively with us.
 

Competition Terms and Conditions


These rules apply for all competitions unless otherwise stated:

• Unless otherwise stated all contestants can enter each competition on Abracadabra only once. All duplicated entries will be deleted.
  
• There can be only one winner per competition and individuals may not enter on another’s behalf.
  
• Unless otherwise stated only one prize will be given and cannot be transferred.
  
• Contestants shall be those who have entered during the time specified on air/on our website and have been selected by a presenter/producer in accordance with the advertised rules for that particular competition.
  
• Unless otherwise stated, the decision on the winning entry rests solely and exclusively with Abracadabra and is final.
  
• We reserve the right not to give away any prize in the event that no winner is found.
  
• Employees of Abracadabra, Sound Start, it’s advertiser agiencies, their affiliates, representatives, family members or households are ineligible to enter or win any competition held by us.
  
• We accept no responsibility for any personal loss/suffering/injuryor material detriment of any kind experienced as a result of entering a competition.
  
• We accept no responsibility for any technical difficulties encountered whilst entering or attempting to enter a competition (such as busy/defective phone lines or an inability to access the website).
  
• We reserve the right to amend, alter or update these terms and conditions and to cancel or suspend a competition, withdraw a prize or disqualify a contestant at any time and for any reason we deem to be valid.  Such reasons may include but not be limited to, an answer being divulged by a third party prior to a competition’s closing date, a contestant supplying inaccurate or misleading personal information such as a false name, address or any other information we may require to constitute a valid entry.
  
• By entering a competition, contestants agree to have their identitie(s) revelaed on air and/or on our website and used in a manner deemed by us to appropriate for the station’s format and design philosphy.
  
• Further to the above, any telephone calls/conversations directly attributable to a particular competition (for example, a contestant giving answers to question(s) over the phone) may also be recorded and used on air and/or on our website and in a manner deemed by us to suitable for the station’s format and design philosophy.  Abracadabra will also retain copyright in such material.
  
• We will make every effort to send out a prize to a winning contestant within 14 working days of the competition’s closing date.
  
• If the event a prize is being supplied by a third party company, sponser or advertiser we do not accept liability in the event of their failure to make the prize available.  This may occur for reasons such as the company in question entering administration or other reasons over which we have no control.
  
• Any prizes not claimed within 3 months of the closing date will no longer be available to winners.

2.3 We cannot warrant that use of the site will not be interrupted or unavailable due to any factors outside our control.

2.5 If you do download or print of copies of the content you must retain any copyright or other intellectual property notices contained in the original material.

2.7 Any rights not expressly granted in these terms are reserved.


3. Changes

3.1 We are continually seeking to update and improve the site. Therefore, we may make changes to any part of the site and these conditions and you will be bound by changes to these conditions form the time you next access the site.

3.2 No purported modification of these conditions will be effective until we countersign it.

4. Downloads

4.1 You must ensure that any content (including any software) downloaded from the internet to your computer is fully compatible with your computer and that it is virus free.This applies to any content/software downloaded directly from this site or download as a result of visiting this site, including but not limited to all site content and any third party plug-ins and/or applications you may be required to install to view and access the site in its entirety.  All such downloads are undertaken at the user’s sole risk.
